This Hold Harmless Agreement (“Agreement”) is entered into between Leaxe, a recreational motor vehicle sharing company, hereinafter referred to as “Leaxe,” and any user of the Leaxe website and mobile app, hereinafter referred to as the “User.”
1. Purpose
Leaxe provides a platform for Users to connect with each other for the purpose of renting, leasing, or sharing recreational motor vehicles, including but not limited to Snowmobiles, ATVs, jet skis, and other similar vehicles. This Agreement is intended to clarify the responsibilities and liabilities of both Leaxe and the User.
2. Assumption of Risk
The User acknowledges and understands that engaging in recreational motor vehicle sharing involves inherent risks, including but not limited to accidents, property damage, and personal injury. The User voluntarily assumes all risks associated with the use of Leaxe’s services.
3. Release and Waiver
The User hereby releases, discharges, and agrees not to sue Leaxe, its officers, directors, employees, agents, and representatives, from any and all claims, demands, actions, causes of action, liabilities, expenses, and damages, whether direct or indirect, known or unknown, arising out of or in any way related to the use of Leaxe’s services, including but not limited to:
- Accidents or injuries related to recreational motor vehicle sharing.
- Property damage caused during the rental or sharing of recreational motor vehicles.
- Any acts or omissions of other Users on the Leaxe platform.
4. Indemnification
The User agrees to indemnify and hold Leaxe harmless from and against any and all claims, demands, actions, causes of action, liabilities, expenses, and damages, including legal fees, arising out of or in any way related to the User’s use of Leaxe’s services or the User’s breach of this Agreement.
5. No Guarantees
Leaxe does not guarantee the quality, safety, or legality of any recreational motor vehicle shared on its platform. The User acknowledges that they are solely responsible for evaluating and assessing the risks associated with renting or sharing a recreational motor vehicle.
6. Compliance with Laws and Regulations
The User agrees to comply with all applicable laws and regulations while using Leaxe’s services. This includes, but is not limited to, obeying traffic laws, wearing appropriate safety gear, and following any local or state regulations related to recreational motor vehicles.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
8. Entire Agreement
This Agreement constitutes the entire agreement between the User and Leaxe regarding the use of Leaxe’s services and supersedes any prior agreements, whether written or oral.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Insert State/Country] without regard to its conflict of laws principles.
10. Acceptance
By using the Leaxe website and mobile app, the User acknowledges that they have read and understood this Hold Harmless Agreement and agree to be bound by its terms and conditions. If the User does not agree with this Agreement, they should refrain from using Leaxe’s services.
11. Acceptance of Terms
By renting a recreational motor vehicle through the Leaxe platform, the User acknowledges that they have read and understood this Hold Harmless Agreement and hereby agree to be bound by its terms and conditions. Renting a recreational motor vehicle through Leaxe is a clear indication of the User’s acceptance of this Agreement.
